Just an fyi, one of the first things I advise most of my clients is to
consider how much they can, or should be in the business of litigation.
Whether we like it or not, litigation is a process that is time consuming
and expensive.  While the idea of never compromising your principals sounds
lofty and noble, the reality is that most people, including most businesses
(including non-profits) are rarely in a position to afford 'their
principles'.  Consequently, most settlements are the result of a realistic
assessment of trying to cut losses, rather than being determined by who is
'right' or 'innocent'.
Not saying I like it any more than anyone else, but I wouldn't be doing my
clients a favor if I didn't point out the fact that that is the nature of
the beast.  From time to time I do have some clients who can 'afford'
litigation and it is nice to be able to get them their due, but they are few
and far between.
One last point is that very rarely are all the 'facts' on the table when
settlements are being discussed, so drawing conclusions about either the
motivation or wisdom of someone who chooses to settle a matter is a risky
business at best.  In the case in point it is safe to say that no matter how
much someone googles up the names of the parties, or even speaks to a
corporate officer, I can pretty well guarantee you that there are countless
details that go into the determination to settle a case that won't be posted
to the internet.
