PARIS (AFP)--Les recettes de cuisine des grands chefs ne sont pas des
oeuvres protégées par les droits d’auteur, mais ne pas les respecter
lors d’émissions de télévision expose au paiement de dommages et
intérêts, selon le tribunal de Paris.

	Le tribunal a condamné récemment la société Les Muses-Production à
payer 160 000 F (27 100$ américains) de dommages et intérêts au
restaurant Le Vieux Logis de Tremolat et à son chef Jean-Pierre
Duribreux.
	Cette société se voyait reprocher par le cuisinier d’avoir diffusé dans
es émissions Travelling Gourmet  l’image d’un autre chef réalisant trois
recettes de M. Duribreux, alors qu’elle l’avait filmé en 1995.
	Les Muses-Production avaient expliqué qu’elles avaient dû refaire
d’urgence un enregistrement car les images de M. Duribreux étaient
floues.
	M. Duribreux avait, lui, invoqué son droit d’auteur sur «l’omelette
paysanne au foie de canard et sauce au jus de truffe» et sur «le
pot-au-feu de filet de boeuf et canard».
	Le tribunal a jugé que «si les recettes de cuisine peuvent être
protégées dans leur expression littéraire, elles ne constituent pas en
elles-mêmes une oeuvre de l’esprit» mais une «succession d’instructions,
une méthode», un «savoir faire, lequel n’est pas protégeable»au nom du
droit d’auteur.
	Il a cependant estimé que la société de production avait commis des
fautes dans l’utilisation des recettes de M. Duribreux et l’a condamnée
à payer 80 000 francs au cuisinier et autant au Vieux Logis, un
restaurant de luxe dont l’image a subi un préjudice.

No copyright on the peasant omelette

PARIS (AFP)--The cooking recipes of the chefs are not copyright
protected work, but not following them in a TV program can result in
payment of liabilities according to a Paris court.

	The court has condom the society Les Muses-Production to pay $27,000 US
of liabilities to the restaurant Le Vieux Logis in Tremolat and to it’s
chef Jean-Pierre Duribreux.
	That company was sued by the cook to have aired in it’s TV show
Travelling Gourmet  an other cook making tree recipes of Mr Duribreux,
even if they taped him in 1995.
	Les Muses-Production explained that they had to retape the programs in
a hurry because the picture of Mr Duribreux were out of focus.
	Mr Duribreux evoked its copy right on «l’omelette paysanne au foie de
canard et sauce au jus de truffe» and on «le pot-au-feu de filet de
boeuf et canard».
	The court judge that even if the recipes can be copyrighted in their
written form they are not a work of the mind but a succession of
instruction, a method, a know how witch can not  protected by a
copyright.
	But the court  has ruled that the production company was at fault in
the use of Mr Duribreux’s recipes and has condone it to pay $13,550 US
to the chef and as much to the restaurant Le Vieux Logis, a high class
restaurant who’s image was attacked.
