 If service was that bad you most likely would never be going back to that 
place again. That was the point of the penny silliness, to show 
dissatisfaction or pleasure at the treatment you recieved. Bit of historical 
custom of the diner if you will that is fading into the past.
 As to the fact most waite staff are actualy living under the so called 
poverty line without tipps I have to agree.
