College of Arms*, under section 3 A that last name would be protected. It
specifically states:
 "3. Names of Significant Personages Outside the Society - Contemporary or
historical personages will generally be considered significant if they
appear in standard references such as an encyclopedia. The names of famous
individuals who do not appear in standard references due to the age and
scope of these works may also be protected on a case by case basis. "
 And again in *The Rules for Submission of the College of Arms*, in section
6 sub section 3 it states:

"3.* Names Claiming Specific Relationships.* - Names that unmistakably imply
identity with or close relationship to a protected person or literary
character will generally not be registered. "

 So with those two rules in mind, I'd say you will have a difficult time
registering that last name. I did find two people in the OP with that last
name. However, that doesn't mean that last name is registered...just that
they are using it and have won an award or two. This is just my two cents
worth and I am sure some other more informed herald will come forward soon.
