[Loch-Ruadh] Question for the Heralds (Past and Present)

Since my device was rejected by the Kingdom Heralds as unregisterable
because it conflicted with all "birds" ever registered (a bird is a
bird is a bird) and other reasons, can I assume that I can feel safe
in not running into another Scadian using my device, registered under
their name? My reasoning is that since I can't register it, neither
can anyone else. I have grown attached to my design and in order to
register it, I would have to change to something unrecognizable to its
present form. The examples of conflicts presented to me bear NO
resemblance to my device in tincture or background layout. My current
idea is to forget about registering my device and just use it. Any
ideas?

On a related note, I was told that (hypothetically) a white raven on a
blue background would be in conflict and therefore unregisterable if
there was already a gold double-headed eagle on a red background. The
reasoning was that there weren't three points of difference. One point
for background tincture, one point for charge tincture, but no points
for charge since a bird is a bird is a bird. These devices would have
only two points of difference. These devices look completely different
no matter how artistically they are drawn, yet they would be in
conflict in the SCA. Any input?
