Now in Texas prepared foods were taxed.  However, sugar and salt type foods were not.  In Alabama everything is.

It seems to me that it doesn't apply to some forms of periodicals, like 
newspapers (which is what you can get if you have a Newspaper guy buddies 
with the guys doing the State Constitution (actually, I maintain that the 
short sightedness and over-engineering that went into framing the State's 
Constitution have a lot to do with the more bizzare screwiness in Oklahoma 
today).
