Yes. Merely sweating doesn't create a copyright, but trancribing
hand-written texts can involve a lot of interpretation, so it's best
for you to assume that it's copyright.

Some transcribers would be happy to give you permission to
redistribute their work, if you can succeed in contacting them. Or,
you might attempt to locate a copy of the manuscript -- many have been
microfilmed -- and transcribe it yourself.
