Once again, CFR 27 to the rescue. If you have a solids content of 60%, you may have up to 12% alcohol without the product being considered potable (I.e., you couldn't eat enough of it to get drunk before you got sick from the sugars present. Note that in practice this usually means up to 11% alcohol, plus or minus 1%.)

Someone asked what the legal definition of an alcoholic beverage is, for our
purposes. After looking all over the 'Net, it's defined in one place as a
beverage containing more than one half of 1% alcohol by weight.
Now I'm REALLY starting to wonder about how some of the candies with
alcoholic centers are defined...
Or, what about jello shots?
