Hmmm.  Not quite.  Though the multiple countries issue is definitely a factor.
U.S. precedent holds that a "slavish reproduction" (i.e. photo) of a 2 dimensional artwork cannot be copyrighted.  Bridgeman v. Corel.

Here's the rub... while it's "precedent" at this point, it's not law.  So, museums (even those in the U.S.) will try to assert copyright on photos/digital images in spite of Bridgeman v. Corel.  Because they know damned well if they want to sue someone like you or I -we're not likely to want to spend the $$ on defending the lawsuit.  And there's always the possibility that another judge might see some other factor not relevant to Bridgeman v. Corel that would cause him or her to uphold the claim to copyright.
So, in spite of Bridgeman v. Corel, a lot of institutions (rightfully or wrongfully) continue to assert their copyright of photos, scans, and digital images.
