Actually, if you read the news stories, it's the latter... Some coperate 
lawyer type knocks on your door and tells you you've stolen their pantented 
genetic material and you WILL be sued unless you fork over licencing fees and God 
knows what else....

Don't know if any have been sucessful yet, but if they drag you through 
enough courts (AND they can), they've done what they set out to do, ruin you.
